Man accused of sexually assaulting 90-year-old woman in her home

Court: Toth was remanded in custody until his trial in February.


A man has appeared in court charged with sexually assaulting a 90-year-old woman in her home.
Norbert Toth, 31, pled not guilty at Livingston Sheriff Court to assaulting the woman by placing his face against his neck, seizing her by her clothes and holding her body against his.
Toth, from Livingston, also denied acting in a threatening and abusive manner by repeatedly striking the front door of a house and demanding entry, urinating in the front garden, entering his alleged victim's home uninvited, shouting and pushing her, putting her in a state of fear and alarm.
He further pled not guilty to a charge of resisting, obstructing, molesting and hindering two female police constables by struggling with them when handcuffs were being applied, shouting and kicking out with his feet.
The alleged attack happened on Wednesday at a sheltered housing complex in Livingston.
Paul Canavan, defending, said the Hungarian national was willing to surrender his passport and identity card and comply with any special bail conditions.
But Sheriff Martin Edington remanded the accused in custody because he considered Toth to be a "flight risk".
He said: "Bail is refused because of the nature and number of these offence allegations which involve appalling allegations against very elderly, vulnerable people in their own sheltered accommodation."
A trial date was fixed for February 12 with an intermediate diet set for January 30.
